Apple Still Salty About Samsung Ruling And Asks For Cease And Desist Of Sales Of GNex And Galaxy Tab 10.1!!!
If you follow the Android world you will know for a fact that as expected Apple sued Samsung the other week. I say as usual because every time Samsung releases a new device sooner or later a patent lawsuit comes down the pipes from Apple. Now, this argument could go either way. Sure some say Samsung rips off Apple, some say Apple is way too litigious for its own good. The fact of the matter remains, Apple has 1 phone and 1 tablet. So they patent every idea they have ever had or will ever use. They use the patent system in the US to their advantage. Is this right? Maybe or maybe not. Is it legal, Yes sir it is! So before you get all bent about Apple, they are just using the system to cover their own ass.
So in typical Apple fashion they threw a patent lawsuit on Samsung. This was over the Galaxy Nexus and the Samsung Galaxy Tab 10.1. Apple won the initial suit and obtained an order that said Samsung must stop all sales of these devices in the United States. The injection was soon put on hold as the ban was delayed on grounds of Samsung’s appeal. This did not stop Apple, however from sending out some rather threatening letters to all retailers selling the Nexus and the Galaxy Tab. The letter applied not only to Samsung but any company “acting in concert” with them. This is basically a strong-arm tactic attempting to force retailers to “comply with the order by ceasing immediately to engage in any of the specified acts (e.g., importing, offering to sell, or selling within the United States) in connection with the Galaxy Tab 10.1 tablet computer.”
This looks to be an attempt by Apple to scare any stores from selling Samsung products until the results of the appeal can be reached. If Apple is right or not remains to be seen, what is true right now is that both the Galaxy Nexus and the Galaxy Tab 10.1 can legally be sold in the United States. The only question is will companies be intimidated by this letter from Apple and will consumers step up and buy Samsung’s products??
