The Trial Of The Century (at least for us) Begins And Why We Think Samsung May Actually Win
I won’t get on my soapbox too much on this one as I chronicled pretty well in my last editorial that covered a Samsung legal brief going into the billion dollar trial between them and Apple. Well we got more. Samsung has brought out some pretty interesting information on their designs previous to the iPhone which Apple seems to think the invented (they actually stole it from the likes of LG , Palm, HTC, Samsung and Sony and we can prove it). Case in point Apple has removed a few of the infringing devices they had listed in their suit after they discovered Sasmsung actually invented them previous to the iPhone.
Remember Palm , and this a point I have brought many times since I began writing about this stuff, well you may remember devices like the Palm Treo 650 seen below. When you talk about prior art, it’s important to note that the Android OEM’s listed in the paragraph above all invented the prior art. There is very little prior art outside of those companies. Apple is lying. There is not a shred of factual basis to their claims and this should be an easy case to prove as I am not a lawyer. I know very little about legal wrangling of any kind, but what I do know, and can and will prove is that Apple did not and simply could not have invented the smart phone(which essentially is what they claim). All of the patents they received and are using originated with someone else. Apple is claiming someone else’s work as their own. Not only is this hypocrisy, it’s lunacy if they win a single dime in the current court proceedings. They continue to try to patent things such as the touch screen ui and the icon and not only that they continue to receive these patents! There is something very wrong with this picture.
The picture is fuzzy to some but here at androrev we don’t take money, devices, tips, or anything else from any tech companies frankly a lot of the blogs are bought they don’t really wan’t to say anything and this is not just the ones that favor apple products the major Android blogs aren’t as direct as they should be either. A lot of their reviews are bologna too. A lot of their post are trying to sell you stuff. That’s why we’re here. Change the guard people don’t listen to them either. Not just the BGR’s and Verge’s of the world but the ones with “Android” in their names too. I don’t believe in impartiality. I love Android but I believe in the facts. My point about the blogs is just that some blogs are just like Apple, pretending to be something that they’re not. My point is I have no reason to do the propaganda thing. If I thought there was a shred of merit to Apple’s case I would say so. I don’t and I won’t. Moving right along to the case in point. Samsung. Below is an image of their devices designed in summer and fall of 2006.
Now, it does not take a genius to fast forward a bit and see that Samsung’s current designs (which I am not a fan of ….. at all ask Joshua Keene) were inspired by Samsung. Samsung’s own prior art, inspired Samsung design. Furthermore, who stole from who? I won’t even go into that one I’ll just point to documents Samsung will prove in court were circulated by Apple executives that reference the designs of Android OEM’s before the iPhone was even began. Oh the great Sony, the actual company the used as a reference point for the icons and the rounded corners that later became the halmark of the iPhone’s design. Sony actually continues to design some of the most aesthetically pleasing devices both inside and outside of Androids. Sony the master of the UI, who deserves a whole ton of credit for the iPhone design. Ever wonder why they are not being sued? Or how about LG who designed a phone you may have heard of called the LG Prada. You can see her below she was the first capacitive touch screen device and won following design awards in 2007.

With that I digress and yes I know I’m going to make a lot of fans with this article. Let’s face it I own this site. I doubt you will EVER see me writing for any of the other blogs I mentioned anyway. You will continue to see us write here and continue to follow the Androidian REVolution philosophy. I think we can be just as big one day with some of the talent here but if we never see that day we are perfectly happy remaining small. We do love Android for the same reason our readers do. It’s a platform that is free and open and therefore represents a bigger ideal for us. We will defend it against anyone trying to shut it down unjustly, and I will speak my mind about the other commercialized media company owned blogs who don’t do Android a bit of service. Who knows one day you will see me and you can tell me exactly what you think about my thoughts. I don’t think I will care much more on that day than I do today. With that I digress. Happy Flashing.
